Terms of Service
Effective: October 8th, 2026
These Terms govern your use of cradlpillows.com and any purchase from Cradl, a brand of BUILTBYAI LLC, 35 Marblehead Rd, Windham, NH. By using the site or placing an order, you agree to them. Section 9 contains an arbitration agreement and class action waiver; please read it.
1. Eligibility. You must be at least 18, or the age of majority where you live, to place an order.
2. Orders and pricing. Placing an order is an offer to buy. We accept it when we ship. We may refuse or cancel any order, including for suspected fraud, resale, or an obvious pricing or listing error; if we cancel after you pay, we refund you in full. Prices are in US dollars and may change without notice. Sales tax is calculated at checkout.
3. Payment. Payments are processed by Shopify and its payment partners. You authorize us to charge your chosen payment method for the order total.
4. Shipping, returns, and refunds. Shipping is governed by our Shipping Policy and returns by our Refund & Returns Policy, both part of these Terms. Title and risk of loss pass to you when the item is delivered.
5. Not medical advice. Cradl products are comfort and positioning products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or condition. Content on our site, emails, and ads is general information, not medical advice. If you are pregnant, have swelling, pain, numbness, circulation problems, a blood clot history, or recent surgery, ask your doctor before using elevation or positioning products. Stop using the product and seek care if pain, swelling, or discomfort gets worse.
6. Product use. Use the product as described. Keep it away from open flame and heat sources. Do not use it with infants or as a sleep surface for babies. Memory foam may have a mild odor at first; airing it out for 24–48 hours usually clears it.
7. Warranties. Our 180-Night Comfort Guarantee and our policy on damaged or defective items are your remedies for product dissatisfaction. Otherwise, to the fullest extent allowed by law, products and the site are provided "as is," and we disclaim implied warranties of merchantability and fitness for a particular purpose. Some states don't allow these exclusions, so they may not apply to you.
8. Limitation of liability. To the fullest extent allowed by law, BUILTBYAI LLC is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim is limited to the amount you paid for the product at issue. Nothing here limits liability that cannot be limited by law, including for personal injury caused by our negligence.
9. Dispute resolution and arbitration. Please contact backyabbot@gmail.com first; most issues are solved quickly. If we can't resolve a dispute within 30 days, you and we agree to resolve it through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court. You and we waive any right to a jury trial and to participate in a class action or class arbitration. You can opt out of this section by emailing backyabbot@gmail.com within 30 days of your first purchase with your name and the words "arbitration opt-out." If the class waiver is found unenforceable, this entire Section 9 does not apply.
10. Governing law. These Terms are governed by the laws of the State of NH and applicable US federal law, without regard to conflict-of-law rules.
11. Reviews and content you submit. If you post a review, photo, or comment, you confirm it is your honest experience and you own it, and you grant us a non-exclusive, royalty-free license to use it in connection with Cradl, including in marketing. We will not edit a review in a way that changes its meaning. We may remove content that is unlawful, abusive, or off-topic. If we ever give you something of value for a review, we will disclose it.
12. Promotions and discounts. Discount codes have the terms shown when offered, can't be combined unless stated, have no cash value, and may end at any time. One code per order.
13. Site content. The Cradl name, site content, images, and designs belong to BUILTBYAI LLC or its licensors. Don't copy or reuse them without written permission. Don't misuse the site, scrape it, or interfere with its operation.
14. Privacy. Our Privacy Policy explains how we handle your information and is part of these Terms.
15. Changes. We may update these Terms by posting a new version with a new effective date. The version in effect when you place an order applies to that order.
16. General. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies they reference are the entire agreement between you and us about the site and your purchases.
